1. Agreement

By engaging rwilliamsdev.com ("we," "us") for web development, consulting, or related services, or by using the free tools on this website, the client or visitor ("you") agrees to these terms.

2. Services

We provide web development, website audits, digital tools, and related consulting as scoped in an individual project agreement, quote, or invoice.

3. Free Tools on This Website

The free website audit and the Instant Preview tool are offered at no charge and without any account, payment, or email signup. The following terms apply to their use:

  • Authorised use only. You may only submit website addresses that you own or are otherwise authorised to test. You are responsible for having that authorisation.
  • Fair use. These tools are for individual, manual use. Automated, bulk, or scripted access is not permitted. We may rate-limit, restrict, or withdraw access at any time, and we may change or remove these tools without notice.
  • Powered by Google. Audit scores are produced by the Google PageSpeed Insights API. Your use of the audit tool is also subject to Google's applicable terms. We do not control, and are not responsible for, the availability or output of that service.
  • Provided "as is." Audit results reflect a single automated test run at one moment in time and may vary between runs. They are provided for general information only.
  • Recommendations come from Google's own audits. Each item listed is an audit that did not pass for the page tested, taken directly from the PageSpeed Insights response. The points figure shown beside it is how much that audit is reducing the relevant Google category score, calculated from the weighting in that response. It describes the score only. It is not a prediction, projection, or guarantee of traffic, revenue, or any other outcome for your website or business.
  • Not professional advice. Audit output does not constitute legal, accessibility-compliance, security, or financial advice. An accessibility score is not an assessment of conformance with the ADA, WCAG, or any other standard, and should not be relied on for that purpose.

4. Payment Terms

  • Pricing is quoted per project before work begins.
  • A 50% deposit is required before work starts, with the balance due on delivery.
  • Late payments beyond 7 days may pause active work until resolved.
  • Prices are quoted in USD. For Kenya-based clients, equivalent KES pricing is available on request.

5. Timelines

Delivery dates are estimates based on information available at project start. Delays caused by late client feedback, content, or approvals may shift delivery dates accordingly.

6. Intellectual Property

Upon full payment, the client owns the final delivered website/tool and its custom content. We retain the right to reuse general code patterns, components, and non-client-specific tools across other projects. Until full payment is received, all work remains the property of rwilliamsdev.com.

7. Revisions

Includes up to 2 rounds of revisions per project phase. Additional revisions are billed at $50/hour.

8. Third-Party Services

Projects and tools may depend on third-party services (hosting, the Google PageSpeed Insights API, Supabase, WhatsApp Business API, domain registrars). We are not responsible for outages, rate limits, pricing changes, or policy changes made by these providers.

9. Limitation of Liability

We are not liable for indirect, incidental, or consequential damages arising from use of the delivered website or tool, beyond the amount paid for the project. For the free tools described in section 3, which are provided at no charge, we accept no liability for any loss arising from their use or unavailability, to the fullest extent permitted by law.

10. Maintenance & Support

Ongoing maintenance/support beyond initial delivery is available under a separate retainer agreement ($100–300/month) and is not included unless specified.

11. Termination

Either party may terminate an active project with written notice. Client is responsible for payment for work completed up to the termination date.

12. Confidentiality

We agree to keep client business information confidential and not share it outside the scope of delivering the contracted service.

13. Privacy

Our handling of personal data is described in our Privacy Policy, which forms part of these terms.

14. Governing Law

These terms are governed by the laws of California, USA, or, for Kenya-based clients, by mutual agreement referencing applicable Kenyan commercial law.
